Big Save Competition and Promotional Rules
Big Save (promoter, we, or us) is running a competition. The competition is a valentine’s day competition where one lucky winner stands a chance to win a R500 grocery voucher.
Definitions. In this Agreement
2.1 Participant or you mean the person who is a Big Save shopper and a Big Save Facebook follower and enters the competition on the specified date.
2.2 Promoter means Big Save or its agencies used to promote this competition.
The competition will run from the 8th February 2020 until - 13th February 2020 (All valid entries will be extracted from the Facebook post). The winner will be randomly selected and the winner will be notified via Facebook. If the finalist cannot be contacted or respond back within 24 hours, we reserve the right to withdraw the potential prize from the finalist and pick a replacement.
4.1 The competition is conducted by the promoter and its third party contractors.
4.2 No one who is a director, employee or agent of or consultant to us or who is a spouse, life partner, close family member (parents, children, brothers and sisters), business partner, or associate to a director, employee or agent of or consultant to us may take part or enter the competition.
4.3 This competition is only open to legal residents of the South Africa aged 18 years or over.
4.4 You must have a valid South African delivery address and ID when claiming a prize.
4.5 Entry into this competition is regarded as acceptance of these terms and conditions.
4.6 Any entries received after the competition period are invalid.
How to enter
5.1 To enter the competition, you must be a SA resident, be over the age of 18 years.
5.2 On the Facebook post tell us: What you will be cooking on Valentine’s Day and tag the person you will be cooking for and let us know which Big Save store is nearest to you.
Consumer Protection Act. Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the Promotional Competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.
We are not liable for any technical failure that may result in an entry not being successfully submitted.
Promotional competition reward
6.1 Prize. R500 grocery voucher to use in store.
6.2 Redeeming prize. We will randomly select and contact a finalist from the valid entries within 24 hours of the close of the competition. We will arrange for the winner to arrive at the store to collect their voucher.
6.3 Limitation to using your prize. Certain conditions may apply to redeeming your prize. We will not be responsible for any loss or damage caused by you not being able to use the prize at a time that is convenient for you.
Prize winner selection and publicity
7.1 Choosing a winner. A winner will be randomly selected from the valid entries.
7.2 We will contact the winner via Facebook. If we do not hear back from them within 24hrs we reserve the right to select another winner.
7.3 We may ask winners to take part in publicity connected to this competition. Winners grant permission for us to use their names, photographs and videos in any advertising and promotional material for this competition. You may ask us to remove your name or refuse to take part in any publicity.
7.4 Winner’s name will be published on our website and on our social media pages.
7.5 You will not receive any payment for taking part in the competition, or taking part in any media format related to it.
7.6 You will need to provide us with a copy of your ID or passport to prove you are the prize winner.
7.7 The prizes are not transferable. You cannot ask us to give you another prize of similar value or to pay out the value of the prize. We may substitute any prize with another prize of similar value.

Breach and termination
If a party: does not fix any breach of this agreement within seven days of receiving written notice from the other party to do so; is insolvent (bankrupt), or has some legal disability, for example, if they are placed under administration; then the other party may, without prejudice to any of its rights: claim specific performance of this agreement (make the party comply with this agreement); or immediately cancel this agreement in writing; and claim damages from the other party.
9.1 Arbitration. If there is any dispute, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator’s decision) under AFSA’s latest rules for expedited arbitrations.
9.2 CPA dispute resolution. Despite 9.1, any party may use other dispute resolution channels provided for by the CPA or other law.
9.3 Severability. This clause is separate and divisible from the rest of this agreement and stays effective even if this agreement ends or is invalid.
10.1 Parties not liable. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
10.2 Notification. If a party cannot fulfil its obligations, because of matters beyond its control, it must notify the other party in writing within 10 days so that they can discuss the way forward.
11.1 No liability. By taking part in this competition you agree that you will not hold us liable for any losses, harm, damages, injury, claims or actions related to this competition.
11.2 Good faith entry. Your entries must be in good faith, you should not circumvent the entry mechanisms in any way. We reserve the right to restrict the number of entries or to reject your entries should we suspect you are circumventing the entry mechanisms.
11.3 Changing the rules. These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential participants.
11.4 Tax. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
11.5 Governing laws. South African laws govern this competition.
11.6 Use of personal information. Participants understand and agree that in order to offer the competition, the promoter must collect and use personal information about them.
11.7 Termination of the competition. If we need to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against us, because of this.
